Update on the UMCH lawsuit (April 2023)

In March 2022, Lifestyle Communities (LC) sued the city of Worthington. The lawsuit involved the UMCH property and LC’s denied proposal from late 2021.


In March 2023, the presiding judge dismissed eight of 10 counts. This is very positive for the city and protects residents’ rights in city zoning.

Since this is pending litigation, I cannot say much other than what is in the public record from the court.

On the advice of city’s counsel, we are pleased the judge’s ruling on the city’s motion to dismiss recognizes the city’s discretion in considering rezoning property. The ruling does not conclude the litigation, which is in the early stages and could continue for an extended period of time.
